Investigating a Violation

 
           Section 40-1-80 of the South Carolina Professions and Occupations Title allows a director of a professional or occupation board to initiate an investigation against licensees who may have violated a regulation. The director may investigate at its own initiative, when the director has reason to believe a violation has occurred, or upon receiving a written complaint charging a person with a violation.     

            The director can also subpoena witnesses and compel evidence to learn all available relevant facts to the violation charges or suspicions. The Code gives the board director the right to apply to an administrative law judge to compel a person to comply with the subquenas or other requests.
